2013 - 2014
In 2013, a two-member Supreme Court bench overturns the 2009 verdict. This was a step back for the Indian Government. The Supreme Court in the 2009 case said that Parliament had the power to reverse the ruling. A conservative Hindu nationalist group, the Bharativa Janta Party, was put into power, making it possible to reverse the Supreme Court's decision. This was a huge step back in LGBT rights in India. It was essentially the re-criminalization of homosexuality. This was a dark day in history for LGBT rights in India.
In 2014, a AIDS non-profit, Naz, took a case to the Supreme Court against Section 377. They were trying to reverse the 2013 decision so to protect people of the LGBT's privacy. This case was shot down and Section 377 is still in effect.
